No-GI/2005/01.—In exercise of the powers conferred by Section 23 read with Section 51-A of the Indian electricity Act, 1910(Act IX of 1910) and Ministry of Power D.O. bearing No.23/52/ 2003-R&R/764/VIP , dated the 11th February,2005, and all other powers enabling him in this behalf, the Administrator, Union Territory ,Chandigarh , is pleased to revise the electricity tariff rates of the various categories of consumers in the Union Territory ,Chandigarh with effect 1st August , 2005 as per below mentioned schedule, This may, therefore , be treated as one month’s notice as required in terms of Schedule appended to the aforementioned Act of 1910.

No.GI/06/1. – In exercise of the powers conferred by Section 135(2) of the Indian Electricity Act, 2003 and ministry of Home Affairs Government of India, Notification No. S.O.721 (E) ,dated 22nd June, 2004 and all other powers enabling him in this behalf, the Administrator, Union Territory ,Chandigarh is pleased to authorize the following officers/officials of Chandigarh Electricity Department for inspecting/ checking the premises of the consumers to detect the theft/misuse of Electricity:--

1. enter, inspect, break open and search any place or premises in which he has reason to believe the electricity has been, is being, or is likely to be, used unauthorized ;
2. search, seize and remove all such devices, instruments, wires and any other facilitator or article which has been, is being, or is likely to be, used unauthorized use of Electricity;
3. examine or seize any books of account of documents which in his opinion shall be useful for or relevant to ,any proceedings in respect of the offence under Section 135(1) of the Electricity Act,2003 and allow the person from whose custody such books of account or documents are seized to make copies thereof or take extracts there from in his presence.

The occupant of the place of search or nay person on his behalf shall remain present during the search and a list of all things seized in the course of such search shall be prepared and delivered to such occupant or person who shall sign the list:

Provided that no inspection, search and seizure of any domestic place or domestic premise shall be carried out between sunset and sunrise except in the presence of an adult male Member occupying such premises.

The provisions of the Code of Criminal Procedure, 1973 (2 of 1974), relating to search and seizure shall apply, as far as may be, to searches and seizure to be carried out by the authorized officer/official.

No. GI/06/2.—In exercise of the power conferred by Clasue (n) of sub- section (2) or Section 180 of the Electricity Act,2003 (36 of 2003) read with Government of India Ministry of Home Affair’s Notification bearing No F, No U-11030/2/2003-UTL, dated in 22nd June ,2004, the Administrator, Union Territory , Chandigarh herby makes the following rules under sub- section (1) of Section 171 of the said Act, namely :--

1. Short title and Commencement.--- (1) These rules may be called the Means of Delivery of Notice , Order or Document Rules, 2006.
   (2) They shall come in to force on the date of their publication in the Official Gazette.
2. Definition.---(1) In these rules unless the context otherwise requires:--
   (a) “Act “ means the Electricity Act,2003 ;
   (b) “Section “ means a section of the Act.
   
   (2) Words and expressions used and hot defined in these rules but defined in the Electricity Act, 2003 (36 of 2003), shall have the meanings respectively assigned to them in that Act.
3. Means of delivery of Notice , order or document.---
   (1) Every notice, order or document by or under this Act required ,or authorized to be addressed to any person maay be served on him by delivering the same through any of the following means:--
   1. through a special Messenger and obtaining signed acknowledgement : or
   2. by telegraphic message: or
   3. by fax ; or
   4. by e-mile ; or
   5. by registered post ;
   6. through Bill-cum- notice in respect of notice under section 56 for disconnection of electric supply.

No. G1/2007/02 – In partial amendment to the Chandiagarh Administration, Engineering Department notitication No. G1/CE/1 ,dated 22nd January, 2001 and in exercise of the powers conferred by the Government of India, Ministry of Home Affairs, - vide Notification No. SO. 721(E), dated 22nd June ,2004 and the clarification given by the Ministry of Power D.O. bearing No. 23/52/2003–R&R/764 VIP, dated the 11th February, 2005. that the Administrator can fix the electricity tariff till Joint Electricity Regulatory Commission is constituted, the Administrator ,Union Territory Chandigarh is pleased to revise the rates of Meter Rentals in respect of various capacities of meters as JERC has still not become functional. This may, therefore, be treated as one month’s notice.

Para at Sr. No. 3 Monthly Meter Rentals of Chandigarh Administration Notification No. 1/CE/1, dated 22nd January, 2001 may be read as under—

In addition to paying the security deposit, a customer shall have to pay the following monthly meter rentals in accordance with schedule of General charges, as amended from time to time :--

1. The above revised rates of Meter Rentals will be made applicable with effect from 1st February, 2007.
2. All other provisions as notified,-- vide Chandigarh Administration, Engineering Department notifications issued,-- vide Chandigarh Notification No. G1/CE/1, dated 22nd January, 2001 will remain same.
